Breaking News: Two month delay for the Unified Patent Court
It was just announced that the start of the UPC sunrise period is postponed for two months. With this adjustment of the timeline, the start of the Sunrise Period is expected to go into effect on March 1, 2023 (instead of January 1, 2023 as initially foreseen). The entry into force of the UPCA is expected for June 1, 2023 (instead of April 1, 2023 as initially foreseen). The delay is caused by technical problems with the strong authentication that is required to access the Case Management System (CMS).
The starting date of the transitional measures offered by the EPO remains unchanged despite the revised timeline of the UPC. At the EPO, applicants can file early requests for unitary effect and for a delay in issuing the decision to grant a European patent as from 1 January 2023.
